Definitions. We/Our/Us: “Lux in Black” Private Transfers or their employees and representatives. Client:The client is the person who makes the booking and takes the responsibility for all other passengers in his/her party. Arrival. Your car will arrive at the appointed time unless we are unable to do so due to circumstances beyond our control. Punctual, our chauffeur will be waiting to meet you at the arrivals gate with a clear sign. Brisbane International Arrivals, your chauffeur will be waiting outside customs on your left hand side, prior to the exit. Brisbane Domestic & Gold Coast Arrivals, your chauffeur will be waiting by your luggage carousel. Authority. The chauffeur is authorised by us to stop the car and ask any passengers to leave the vehicle if in his opinion they act contrary to our conditions of hire in any way. The passengers must not distract, interfere with or encourage or harass the chauffeur into breaking the law or any of these conditions. Damage. If our vehicle is damaged or soiled as a result of passengers’ actions, we will charge the client named on the contract fully for the amount to rectify the vehicle and for time lost whilst the vehicle was taken out of the fleet. Licensing/Insurance. We are licensed operator and we are fully insured. We will not carry more passengers than our insurance or licensing allows. Liability. Every effort will be made to get you to your destination on time, but we are not liable for any loss due to delays caused by traffic jams, road works, road closures, diversions, extreme weather conditions, collisions caused by third parties, or act of terrorism. Route. The route taken is at the chauffeur discretion. The driver will take the best possible route and in the event of heavy traffic congestions, he will amend the route if necessary and endeavour to deliver passengers to their destination on time. “Lux in Black” does not accept responsibility for any delays or missed appointments or travel arrangements. Always allow plenty of time four your journey. Quotations. A Quotation can be verbal, in writing or by e-mail and will be based on information supplied by you. The quotation will be considered as binding by us subject to these terms and conditions and will be valid for 30 days. The quotations will become invalid if there is any material change to the itinerary. We reserve the right to re-quote for any such circumstances. Any change to the itinerary once the journey has commenced will be charged extra. Booking confirmation. Your booking is not secured until you receive confirmation. Once we have all your transfer details, we will check and confirm availability and request payment. This will by phone, fax or e-mail. Please check your booking confirmation carefully and inform us of any errors. We will endeavour to check all flight details, connection time, etc. supplied to us by you but we cannot be responsible for any errors or cancellations or timetable changes which result in loss or delay to you. Termination. We reserve the right to terminate any booking if it is felt not to be genuine or places our chauffeur or vehicle at risk of damage / abuse. Our vehicle will leave the vicinity of any disturbance and only return when safe to do so. We will terminate the hire with immediate effect and ask that you and any fellow passengers vacate the vehicle (when safe to do so). This will be at the chauffeur's discretion if you or any passenger commit any act that threatens the safety of the vehicle or its occupants. If any part of the journey remain in such a situation there will be no refund. Payment. We reserve the right to ask for full payment or a deposit of 50% when making a booking. These can be made by credit card, debit card, cash, or cheque made payable to “Lux in Black” (which must be cleared by the time of travel). Where a booking deposit is accepted the balance will be paid 24 hours before travelling. Credit card payment: We can only accept credit cards payment from you or your company (if on behalf of you). We cannot accept credit card booking from third parties. A full address for the booking must be supplied and must either be connected with you (your accommodation, your private residence or place of work). We will only accept phone bookings from a verifiable and fixed phone line or mobile. Cancellation. Any advance booking is only secured once we have received your deposit/payment. Short notice bookings will require full payment before travel. If you receive your confirmation and decide not to proceed with you booking please contact us as soon as possible. We will only refund deposits up to 24 hours before the journey commencement. Delays – Transfer. The chauffeur will wait for up to one hour after the arranged pick up time at no extra charge. If however the flight / ship /train arrival time is amended due to delays following the chauffeur’s arrival at the airport / port / train station, then additional waiting time will be charged at our basic hourly rate from the current tariff ( waiting time: $1.5 per minute). If, as a result of extreme delays the chauffeur is required to return to the airport / port / train station in order to collect the client, then this will be at the convenience of “Lux in Black”. “Lux in Black” is obliged to carry out other pre-booked reservations, and cannot cause delays and inconvenience to other clients as a result of flight / ship / train delays. To ensure that a vehicle is available for you late arrival please inform us (0410 817 731) as soon as you are aware of any delay to your arrival time. Airport Transfer – Non Arrival. If following a reservation the client fails to arrive on the flight detailed at the time of reservation then the chauffeur shall wait for a maximum of two hours starting from the flight’s expected arrival time. An extra charge will be incurred for the additional one hour. This will be charged at our basic hourly rate of the current tariff (waiting time: $1.5 per minute). If after this time the client fails to arrive, no refund will be issued. Subcontractors. We reserve the right to use subcontract chauffeurs when needed. We vet all subcontractors to ensure the same high standard we expect from ourselves. Alterations. We reserve the right to amend any tariff published at the minimum of notice. All existing confirmed bookings will be at the rate quoted or applicable rate in effect at the time of booking. Smoking. In accordance with Australian Law, smoking in the car is not permitted. The chauffeur will stop for a break if requested. Please inform us in advance if this is required to allow extra time for the journey. Refunds. All refunds will be made to the credit card used for payment. Children. We provide child car seats if requested at the time of booking and are free of charge. The parent/carer is responsible for the safety of the child at all times. Illegal material. The posession or use of any drugs or weapons in vehicle is forbidden. Dogs. Dogs and cats are allowed in our vehicle but must be declared at the time of booking and must be carried in appropriate cages. Exceptions are made for guide dogs. Jurisdiction. The Terms and Conditions set out above shall be governed and are construed in accordance with Australian Law. |
